New Ruling Clarifies or Confuses? Depends on Your Side The Arizona Appellate Court, Division One, recently issued a decision which affects business owners and their spouses during divorce. Calculating the community interest in a business started prior to the marriage is complicated, and the Court's opinion in Rueschenberg v. Rueschenberg, --- P.3d ----, 2008 WL 2026338 (Ariz. App. Div. 1) entered on May 13, 2008, attempts to clarify how to make such a determination. Both the net worth increase in value of the separate property business and the profits from that separate property business earned during the marriage are subject to equitable division. The case establishes that reasonable compensation (ie salary or draws taken by the business owning spouse if reasonably equal to a salary at a comparable company) no longer precludes an award of increased value or profits to the other spouse, in the event that the reasonable compensation does not equal or exceed the portion attributable to the community for its share of the increase in value and/or profits. The party seeking to have the separate property business and any increase in value and/or profits deemed separate has the burden of proof.
